_Smith & Singer Approved at VCAT

Collie was engaged to assist Smith & Singer in obtaining planning approval for use of its high-end art, jewelry and sculpture display and sales facility at its new location in the State-significant historic Darnlee building in Lansell Road in Toorak (Melbourne), Victoria. 

Darnlee is a single storey red brick building that was built in 1899 and designed by Leonard John Flannagan in the Federation Style.  The building is included in a Heritage Overlay and on the Victorian Heritage Register and includes elements of architectural importance including a tower, entrance porch, front fence and a high level of ornamentation.

A large three-level extension was built in the late 1990s to the rear of the original building in association with the use of the site by Blue Cross as a residential aged care facility, which ceased operation shortly before the site was purchased by Smith & Singer. 

Collie assisted with the preparation and submission of the planning permit application to Stonnington City Council (Council) for use as an ‘art and craft centre’, which resulted in a number of objections to its perceived impact on the heritage building and the residential area and whether it should be defined as a different use. 

The proposed use will have a low impact on the building and surrounding residential area and will ensure the preservation of the heritage value of the site, noting that its heritage appeal and ease of access for clients, were two key reasons that the site was chosen for the proposed use. 

An application for review was lodged with the Victorian Civil and Administrative Tribunal (VCAT) on Council failure to make a decision within the specified timeframe. 

During the compulsory conference it was agreed between all parties that the proposed use would be better defined as an ‘auction house’ and permit conditions were negotiated as part of this process.

A planning permit has now been issued by Council and we look forward to the use commencing.
